Consultation response on a proposal regarding adults who cannot decide for themselves concerning health care, social services and research (SOU 2015:80)

The task of the public inquiry was to propose a simple and practical regulation regarding adults who, because of their condition, cannot exercise their right to self-determination concerning health care, social services and research.

The Swedish National Council on Medical Ethics welcomes the committee report and is primarily positive regarding the proposed regulation. However, the Council has some comments on for example who should make the decision that a person is in need of a representative and the status of a previously expressed wish regarding health care. The Council also believes that the report lacks argument on important ethical questions concerning research.
